Active Litigation Status Does Not Affect Psychological Distress or Disability in the Setting of Whiplash Injury

Summary

  1. These authors do not note increased disability, sleep difficulties, or psychological problems among active litigants as compared to those who have resolved their legal claim.
  2. They do find an increased perception of pain among active litigants. However, in this retrospective study, they can only speculate about the effects of active litigation on pain perception.
  3. They note that a prospective study would help sort out the relationship of active litigation to pain perception. This would also help to clear up any confounding effects noted here such as a longer interval of follow-up after the date of injury for studying the post-litigants versus active litigants.
